Trump’s Transgender Troop Ban Struck Down by Court

Sumbawanews.com,- A federal appeals court has ruled that President Donald Trump’s policy barring transgender individuals from serving in the U.S. military violates the Constitution’s guarantee of equal protection — a landmark decision that splits the bench but affirms the service of thousands of qualified troops.

The U.S. Court of Appeals for the District of Columbia issued a divided ruling on Monday, with two judges rejecting the administration’s claim that being transgender is incompatible with military values, while a third dissented, arguing that courts lack authority to interfere in military personnel decisions.

Judge Robert Wilkins, appointed by President Barack Obama, authored the lead opinion, declaring the policy “blatantly discriminatory” and rooted in “the bare desire to harm a politically unpopular group.” He cited Trump’s January 2025 executive order, which labeled transgender service members as dishonest, arrogant, and unfit for duty — assertions Wilkins called “insulting” and unsupported by evidence. The court noted that the plaintiffs in the case had collectively served over 130 years in uniform and received more than 80 commendations for their service.

“The administration forfeited any credible argument that retaining these service members threatens national security,” Wilkins wrote, emphasizing that the Pentagon’s own data showed no operational harm from transgender troops serving openly under prior policy.

Judge Judith Rogers, a Clinton appointee, concurred with Wilkins but went further, arguing the ban should also be blocked for transgender individuals seeking to enlist. She pointed to testimony showing that excluding qualified transgender recruits deprives the military of skilled personnel at a time of recruitment challenges.

“The military’s strength lies in its diversity of talent — not in excluding those who meet the standards,” Rogers wrote.

The third judge, Justin Walker — a Trump appointee — dissented, insisting that the judiciary overstepped its constitutional role. “The Constitution entrusts military personnel decisions to Congress and the Commander in Chief,” he wrote. “Courts lack the expertise, authority, and institutional legitimacy to second-guess those judgments.”

The ruling partially upholds a lower court’s preliminary injunction, blocking the removal of transgender service members already in uniform — but it lifts the injunction’s application to new recruits, allowing the administration to temporarily bar transgender individuals from enlisting while litigation continues.

The Pentagon, under Defense Secretary Pete Hegseth, has already signaled its intent to appeal. In a terse social media post, Hegseth wrote: “See you at SCOTUS.”

The decision comes amid a broader legal and political battle over transgender rights under Trump’s second term. The administration’s policy, formalized in a February 2025 Pentagon memorandum, disqualified service members who had undergone gender-affirming care or received a diagnosis of gender dysphoria — a move critics called medically unfounded and politically motivated.

LGBTQ+ advocacy groups and Democratic lawmakers celebrated the ruling as a critical defense of dignity and service. Representative John Larson of Connecticut called the ban “discrimination — plain and simple,” vowing to continue fighting “these attacks on our troops and all transgender Americans.”

Legal experts warn the case is likely headed to the Supreme Court, which previously paused similar injunctions in 2025. Until then, transgender service members remain protected from discharge — but new recruits face continued uncertainty.

The military, once hailed as a merit-based institution, now finds itself at the center of a constitutional clash over identity, equality, and the limits of presidential power.
